The United States Supreme Court- Law Makers?

Jim Riley

9th June 2009

There is a good piece in the Washington Post on the old chesnut of what are Supreme Court justices actually supposed to do- make or interpret law?

First Amendment lawyer Kevin Baine states that “never let it be said that judges do not make law or policy”, and refers to the controversy of Supreme Court justices in “remaking law enacted by elected representatives”, referring to the landmark cases of Roe vs Wade, Brown vs Topeka and others, before bringing the issue right up to date with potential issues Sotomayer might face.

This is a great article which could act as a springboard for discussions on the role of judges in a democracy and the judicial activism.
